Terms of Service

Article 1 (Purpose and Acceptance)

These Terms of Service ('Terms') govern your access to and use of KVID AI's AI-powered content generation services ('Service'). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Article 2 (Definitions)

1. 'Service' refers to all AI-based image and video generation services, tools, features, and related websites provided by KVID AI.
2. 'User' or 'You' means any individual or entity that accesses or uses the Service.
3. 'Account' means a unique account created for you to access our Service.
4. 'Content' refers to any images, videos, text, or other materials generated, uploaded, or shared through the Service.
5. 'Credits' means the virtual currency used to access premium features of the Service.
6. 'AI Models' refers to the artificial intelligence technologies used to generate Content.

Article 3 (Eligibility and Account Registration)

1. You must be at least 18 years old or have parental consent to use the Service.
2. You must provide accurate, current, and complete information during registration.
3. You are responsible for maintaining the confidentiality of your account credentials.
4. You may not transfer, sell, or share your account with others.
5. You must notify us immediately of any unauthorized use of your account.
6. We reserve the right to refuse service or terminate accounts at our discretion.

Article 4 (Service Usage and Credits)

1. The Service operates 24/7, but may experience temporary interruptions for maintenance.
2. Access to certain features requires Credits, which can be purchased through our payment system.
3. Credits are non-transferable and subject to our Credit Policy.
4. We may modify, suspend, or discontinue any aspect of the Service with notice.
5. Usage limits may apply to prevent abuse and ensure service availability.
6. Commercial use of the Service requires appropriate licensing.

Article 5 (Content and Intellectual Property)

1. You retain ownership of Content you create using the Service, subject to the input materials' rights.
2. You grant us a worldwide, non-exclusive license to use your Content for service improvement and as permitted by our Privacy Policy.
3. You are responsible for ensuring your Content does not infringe on third-party rights.
4. We retain all rights to the Service, including AI Models and underlying technology.
5. You may not reverse engineer, decompile, or attempt to extract our AI Models.
6. Attribution to KVID AI may be required for certain uses of generated Content.

Article 6 (Prohibited Conduct)

You agree not to:

1. Generate Content that is illegal, harmful, threatening, abusive, defamatory, or discriminatory
2. Create Content that infringes on intellectual property rights or privacy rights
3. Use the Service to generate misleading or deceptive content (deepfakes for harmful purposes)
4. Generate adult content involving minors or non-consensual intimate content
5. Attempt to bypass usage limits or security measures
6. Use automated systems or bots to access the Service without permission
7. Resell or redistribute the Service without authorization
8. Engage in any activity that disrupts or harms the Service or other users

Article 7 (Privacy and Data Protection)

We collect and process personal data in accordance with our Privacy Policy. By using the Service, you consent to such processing and warrant that all data provided by you is accurate. We implement appropriate security measures to protect your data.

Article 8 (Payment and Refunds)

1. Payments are processed through Dodopayments, our third-party payment processor.
2. All prices are listed in the currency specified and include applicable taxes.
3. Refunds are handled according to our Refund Policy.
4. We are not responsible for any fees charged by your bank or payment provider.
5. Subscription renewals are automatic unless cancelled before the renewal date.

Article 9 (Disclaimers and Limitation of Liability)

1. The Service is provided 'as is' without warranties of any kind.
2. We do not guarantee the accuracy, completeness, or usefulness of generated Content.
3. We are not liable for any indirect, incidental, or consequential damages.
4. Our total liability shall not exceed the amount you paid in the past 12 months.
5. We are not responsible for Content created by users or third-party services.
6. Force majeure events excuse us from liability for non-performance.

Article 10 (Indemnification)

You agree to indemnify and hold harmless KVID AI, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service or violation of these Terms.

Article 11 (Termination)

1. You may terminate your account at any time through account settings.
2. We may suspend or terminate your account for Terms violations.
3. Upon termination, your right to use the Service ceases immediately.
4. Certain provisions of these Terms survive termination.
5. We may delete your Content after account termination per our data retention policy.

Article 12 (Modifications to Terms)

1. We may modify these Terms at any time with 7 days notice for material changes.
2. Continued use after changes constitutes acceptance of new Terms.
3. We will notify you of changes via email or Service notification.
4. You may reject changes by discontinuing use of the Service.

Article 13 (Governing Law and Disputes)

1. These Terms are governed by the laws of the Republic of Korea.
2. Disputes shall be resolved through good faith negotiation.
3. If negotiation fails, disputes shall be submitted to the competent courts of Korea.
4. The UN Convention on Contracts for International Sale of Goods does not apply.

Article 14 (General Provisions)

1. These Terms constitute the entire agreement between you and KVID AI.
2. If any provision is found invalid, other provisions remain in effect.
3. Our failure to enforce any right does not constitute a waiver.
4. Section headings are for convenience only and do not affect interpretation.
5. These Terms do not create any third-party beneficiary rights.

Supplementary Provisions

These Terms are effective from December 8, 2025. Previous versions of the Terms are archived and available upon request.
